    • eligibility to participate in an event or activity (including where a participant is under the age of 18 years);

    • a right to stop the participant either starting or carrying on with the event or activity;

  • requires you to complete the items in red text being your business name and ABN, the Event details and the Activities that will be undertaken at the Event;

  • is limited to an exclusion for liability for death and injury only to ensure that the indemnity is not too broad and will come under section 139A of the Competition and Consumer Act 2010 (Cth). If it also applies to property damage, the waiver may be too broad and lose its legal effect under that section. Accordingly, this Accident Waiver and Release of Liability form template does NOT apply to personal property; and

  • is a general template drafted for Australian laws and does not incorporate specific disclaimers that you might require if you offer particularly specialised Events. Note: Even in cases where a waiver / release form is signed, if the event organiser is considered to be reckless or negligent in regard to the personal safety of its participants, then the waiver may not apply.
