Frequently Asked Questions about NDIS Contracts

What is a NDIS Service Agreement?

A NDIS Service Agreement is a contract between a NDIS participant and the disability service provider. The service provider can provide any support such as personal care, cleaning, allied health services, etc.

DO I HAVE TO HAVE A SERVICE AGREEMENT

While it is not compulsory by law to have a service agreement, it is recommended to make sure there is a clear agreement and that both the support provider and the NDIS participant are on the same page. It also helps where the NDIS participant has a carer (or more than one carer) to keep things documented and in order.

WHAT NEEDS TO GO IN MY NDIS SERVICE AGREEMENT?

The Service Agreement should clearly outline the services that will be delivered, how they will be delivered, and the responsibilities of both parties in providing and receiving those services and how they can be changed. It should also be clear on how to end the contract and where complaints about service should be lodged.

HOW DO I GET PAID AS A NDIS PROVIDER?

Depending on how the NDIS plan is managed, you can be paid by the NDIS participant, the NDIS, or a plan manager.

WHAT IS THE NDIS PRICE GUIDE?

The NDIS price guide sets out the maximum prices or line items that a NDIS provider can charge a NDIS participant for certain types of things. It is a good idea for this to be referenced in the NDIS contract next to the price when a service provider is completing their service agreement.

CAN A NDIS SERVICE AGREEMENT BE CHANGED OR ENDED?

Yes, a service agreement can be changed and/ or ended. The process should be included in the service agreement so both the NDIS participant and the service provider know how to do this and the process is clear.

WHAT IF AN NDIS PLAN CHANGES? DOES THE SERVICE AGREEMENT NEED TO BE UPDATED?

Commonly, NDIS plans are reviewed annually but they can also be reviewed or changed if the needs of the NDIS participant changes. Changes to a plan can mean the services need to change and if this happens, it needs to be documented by a variation to service agreement and should be done in writing to make sure there is a paper trail following any such changes.
