The Remote Work Agreement (non award) is a template employment agreement for an employer wanting to employ a remote employee.

It is suitable for a wholly remote or partly (hybrid) remote employee.

By using a specialised remote work agreement template the Employer and the Employee will be clear on:

  • where the employee will work from;

  • who is responsible for workplace health and safety (WHS) obligations in the remote workspace;

  • how employee expenses are claimed/ paid (and whether the employee is permitted to claim certain items as expenses);

  • who is to supply the equipment required for the role;

  • the hours the employee will work; and

  • other specific arrangements such as the frequency the employee is to visit head office.

This template, once downloaded, requires completion of the details of the Employee’s proposed remote workspace and other deal specific details in the customisable Schedule.

If the role you are hiring for is covered by a Modern Award and/ or your employee plans to work outside of the usual Award Hours please be aware that this arrangement could attract penalty rates under the Modern Award. In that case consider using the Remote Work Employment Agreement (Award) in addition to an Individual Flexibility Agreement to contract out of the Modern Award.
