The Individual Flexibility Agreement is a template that is used with the Remote Work Employment Agreement (Award). It will only be required if an employer hires an employee under a Modern Award and wants to vary that award with the consent of the employee to document flexible work arrangements.

The Individual Flexibility Agreement is a template that is used with the Remote Work Employment Agreement (Award).

It will only be required if an employer hires an employee under a Modern Award and wants to vary that award with the consent of the employee to document flexible work arrangements.

In this regard, note that Modern Awards set out the minimum terms and conditions that employers MUST offer employees in specified occupations. However, each Modern Award contains a flexibility term allowing the conditions of the Modern Award to be varied by mutual agreement of the employer and employee. The mutual agreement part is very important so that it can be confirmed the employee is aware of the Award and understands the variation and agrees that it will be of benefit to them overall compared to the Modern Award coverage.

Note also, either party can request a flexibility term under an Individual Flexibility Agreement but the employer has the responsibility to make sure the employee is better off overall under the Individual Flexibility Agreement rather as opposed to the relevant Modern Award.
